Prosecutors have dropped a charge against a Hanahan man accused of brutalizing a woman during a sexual tryst arranged through Craigslist, court records showed. Deputies had arrested John Phillip Burnside, 33, of Murray Drive on a count of first-degree criminal sexual conduct on Sept.
The woman relayed to investigators that she had told Burnside to stop after he started slapping her hard during their Aug. But Burnside's attorney, Andy Savage of Charleston, argued during a preliminary hearing last month that text messages between the two showed that the entire rendezvous had been agreed upon. The messages included details of their discussions about dominant and submissive sexual behaviors, Savage said then.
Many of the texts had been deleted from the accuser's cellphone, but sheriff's forensics experts managed to recover them. The veteran who worked as a contractor in Afghanistan has been free since then.
On Friday, the 9th Circuit Solicitor's Office submitted court paperwork stating that Burnside's charge had been dropped and that he had not been indicted. Edit Close.
